Terms of Service

By accessing or using Surging Markets ("the Platform"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Platform. These Terms incorporate our Privacy Policy and Refund Policy by reference.

1. Educational Purpose — Not Financial Advice

Surging Markets provides trading signals, AI coaching, community features, and educational content for informational and educational purposes only. Nothing on the Platform constitutes financial, investment, tax, legal, or trading advice, nor a solicitation or recommendation to buy, sell, or hold any financial instrument. Trading involves substantial risk of loss and is not suitable for all investors. Past performance — including signal accuracy, backtests, and member results — does not guarantee future results. You should consult an independent licensed adviser before making any investment decision.

2. Subscriptions, Auto-Renewal & the Ignite Challenge

Most plans are recurring subscriptions billed in advance through Stripe. By providing a payment method you authorize Surging Markets to charge that card on each renewal date until you cancel.

Ignite Challenge disclosure (important): The $3 Ignite Challenge is a 7-day paid trial. At the end of day 7, the same payment method is automatically enrolled in the Surging Markets Pro subscription at $99 per month and continues to renew monthly until you cancel. You can cancel any time before the trial ends from your account at /account/subscription to avoid the $99 charge. The trial price, renewal price, billing interval, and cancellation method are also disclosed on the checkout page before you confirm payment.

Other plans (Daily, Weekly, Monthly, Yearly, Surge Lifetime, DWY, Coaching Accelerator) have the price, term, and renewal frequency shown on the checkout page. One-time purchases do not auto-renew.

3. Cancellation

You may cancel a recurring subscription at any time, effective at the end of the then-current billing period, by any of the following methods:

Cancellation stops future charges. Refund eligibility for the most recent charge is governed by the Refund Policy.

4. Refunds

Refund windows, the Surge Lifetime Profitable-or-Free guarantee, and exclusions are set out in full in our Refund & Profitability Guarantee Policy, which is incorporated into these Terms. In summary: standard subscriptions carry a 7-day money-back guarantee from the first charge; the Surge Lifetime tier carries a 90-day cash-refund window or a Profitable-or-Free extension; one-time digital products are non-refundable once accessed.

5. Payments & Stripe

All payments are processed by Stripe, Inc. By submitting payment information you also agree to Stripe's End User Terms of Service and Privacy Policy, which are incorporated by reference. Surging Markets does not store full card numbers on its own servers. Failed renewal payments may be retried by Stripe under standard dunning rules; persistent failure suspends access until the balance is resolved.

6. Earnings & Affiliate Disclaimer

Any income, P&L, leaderboard, testimonial, or affiliate-commission figure shown on the Platform is illustrative and not a guarantee of future earnings. Individual results vary significantly; most users earn little to nothing. Affiliates must clearly disclose their relationship with Surging Markets in promotional content, per FTC guidelines (16 CFR Part 255).

7. Acceptable Use

You agree not to: share your account credentials; scrape, mirror, or redistribute Platform content; resell signals or course material; post illegal, harassing, defamatory, or fraudulent content in community spaces; use the Platform to promote competing services; or attempt to interfere with the Platform's security or availability. Violations may result in immediate suspension without refund.

8. Intellectual Property

All content on the Platform — including signals, indicators, dashboards, analyses, videos, course materials, and brand assets — is the property of Surging Markets Ltd or its licensors and is protected by copyright and trademark law. You receive a limited, personal, non-transferable, non-exclusive license to access and use the Platform for your own trading and learning while your subscription is active. No other rights are granted.

9. App Store (iOS & Android)

If you access the Platform through Apple's App Store or Google Play, these Terms apply in addition to the platform's standard end-user license agreement (Apple EULA / Google Play Terms). The store operator is not a party to these Terms and is not responsible for the Platform, its content, or any support obligations.

10. Limitation of Liability

To the maximum extent permitted by law, Surging Markets Ltd, its officers, employees, and affiliates are not liable for: (a) any trading, investment, or financial losses; (b) decisions made on the basis of Platform content; or (c) any indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform. Our aggregate liability for any direct claim is capped at the amount you paid Surging Markets in the 12 months preceding the claim.

11. Modifications

We may update these Terms from time to time. Material changes will be notified by email or in-product banner at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. The parties will attempt in good faith to resolve any dispute informally within 30 days. Any unresolved dispute is subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in this clause limits any non-waivable consumer right you have under the laws of your country of residence.
